  1. Use permit to extend a use which is a less restricted district (R-3) into a more restricted district (R1-14) to a maximum of 25 feet. Use permit required.
  2. Variance to allow a 110 feet encroachment into a more restrictive zoning district. Maximum 25 feet encroachment allowed.
  3. Variance to reduce the landscape setback from the property line along Baseline Road to 29 feet. Minimum 50 feet required.
  4. Variance to reduce the landscaped separation between the sidewalk and multi-use trail along Baseline Road to 1 foot. Minimum 5 feet required.

Stipulations
  • ZA - 1) Two years to apply and pay for building permits.
  • ZA - 2) The development shall be in general conformance with the revised site plan received by City of Phoenix on August 10, 2020, as signed and dated by the Zoning Adjustment Hearing Officer with specific regard to limiting relief from the 50-foot landscape setback from Baseline Road to 109 feet east-west and to rerouting the multi-use trail north of the bus bay “hoop” structure, limiting the area of Variance #4 to the 74 feet +/- east of the bus bay to 32nd Street as shown on the plan.
  • ZA - 3) The development shall provide a minimum of two gathering places, e.g. seating areas accessible to the public, one along 32nd Street and one along the Western Canal, as approved by the Planning & Development Department.
  • ZA - 4) A minimum landscape setback of 30 feet shall be provided along the northern property line, as approved by the Planning & Development Department.
  • ZA - 5) A minimum landscape setback of 93 feet shall be provided along 32nd Street, as approved by the Planning & Development Department.
  • ZA - 6) No perimeter fence or wall shall be permitted on any portion of the open space area on the development site parallel to 32nd Street.
  • ZA - 7) Citrus trees shall be planted in a double row along Baseline Road, at entrances to the site from Baseline Road and 32nd Street, and throughout the development site, as approved by the Planning & Development Department.
